Adjustment of status is primarily governed by INA § 245, codified at 8 U.S.C. § 1255, and implemented by regulations at 8 C.F.R. part 245. It allows certain noncitizens in the United States to apply for lawful permanent residence without having to leave the country.

What Is AOS?

Adjustment of status is the process of “adjusting” from a temporary or other status to that of a lawful permanent resident if:

  • You are eligible for an immigrant visa category
  • A visa is immediately available (subject to numerical limits)
  • You are admissible or qualify for a waiver, and
  • You meet specific procedural requirements under INA § 245 and 8 C.F.R. part 245
