K-1 visas are authorized under INA § 101(a)(15)(K) for fiancé(e)s of U.S. citizens and are implemented in regulations such as 22 C.F.R. § 41.81. They allow a foreign-citizen fiancé(e) to enter the United States to marry a U.S. citizen and then apply for adjustment of status.

Vargas Gonzalez Delombard, LLP does not prepare fiancé(e) visa petitions, as we focus on business-related immigration issues. However, we work with attorneys who have experience in immigration law and regularly handle K-1 cases and related green card applications.

What Is a K-1 Visa?

A K-1 fiancé(e) visa generally requires:

  • A bona fide intent to marry within 90 days of entry
  • Proof of a qualifying relationship and in-person meeting (with limited exceptions)
  • Approval of a fiancé(e) petition by USCIS before consular processing

After marriage, the foreign spouse typically applies for adjustment of status under INA § 245.
