Refugee admissions are governed by INA § 207, codified at 8 U.S.C. § 1157, and implemented by regulations such as 8 C.F.R. part 207. These provisions establish annual refugee admission ceilings and the process for admitting refugees of “special humanitarian concern” to the United States.

Vargas Gonzalez Delombard, LLP does not process refugee applications abroad; however, we collaborate with attorneys who specialize in immigration law, particularly in refugee resettlement, derivative benefits for family members, and subsequent adjustment of status.

What Does Refugee Status Mean?

A “refugee” is generally someone outside their country of nationality who is unable or unwilling to return due to persecution or a well-founded fear of persecution on protected grounds, as defined in INA § 101(a)(42).

Refugees typically:

  • Are referred by international organizations or U.S. refugee programs
  • Undergo screening, interviews, and security checks abroad
  • Enter the U.S. with refugee status and may later adjust to permanent residence under INA § 209
